As we were preparing this edition of the EBIA Weekly, the DOL made available an advance copy of temporary regulations implementing the paid sick and family leave requirements under the Families First Coronavirus Response Act (FFCRA) (see our Checkpoint article). The temporary regulations, effective April 1–December 31, 2020, cover many details regarding FFCRA paid sick and family leaves, including which employers must provide the leaves and the employer’s responsibility to maintain an employee’s coverage under the employer’s group health plan during such a leave. Previously, the DOL issued FAQs on the FFCRA leave requirements (see our Checkpoint article).
