Group Health Plan Mandates. Our discussion of USERRA’s health plan reinstatement rights has been expanded with new analysis of the interaction between health care reform’s employer shared responsibility rules and leave for uniformed service under USERRA. We’ve also updated our ADA discussion about discrimination on the basis of an individual’s relationship or association with another individual with a disability. And we’ve expanded our mental health parity coverage for more analysis of plan exclusions of residential treatment services for substance use disorders. COBRA: The Developing Law. We have updated our discussion of the circumstances under which an employer may pay COBRA premiums on a pre-tax basis through a cafeteria plan. We have also expanded our coverage of COBRA issues in mergers and acquisitions to include practical examples of the obligations of the buying and selling groups in an asset sale. We have added a new subsection on COBRA’s applicability to retiree-only HRAs. And we have updated our SHOP discussion to describe the employee choice model and its implications for COBRA administration.
