Group Health Plan Mandates. We have reorganized and expanded our coverage of how GINA applies to wellness programs, including new analysis of proposed EEOC regulations addressing GINA’s application to wellness programs with health risk assessments and discussion of EEOC litigation challenging these programs. We’ve also reworked our discussion of how to determine whether health coverage is considered creditable for purposes of the Medicare Part D creditable coverage disclosures and expanded our analysis of who is considered a Part D eligible individual with examples and tips. HIPAA Portability, Privacy & Security. We’ve updated our discussions of preexisting condition exclusions and lifetime and annual dollar limits to reflect final regulations. We analyze three new resolution agreements settling alleged privacy and security violations and an administrative decision upholding civil penalties for inadequate privacy policies and procedures. We explain HIPAA privacy issues related to new reporting requirements under health care reform. And we review recent guidance clarifying individuals’ rights to access their own PHI, with corresponding updates to our sample request to inspect or copy PHI.
