Final regs modify rules on eligibility for and amount of premium tax credit

(12/15/2016) - IRS has issued final regs relating to the Code Sec. 36B premium tax credit and the individual shared responsibility provision under Code Sec. 5000A (commonly referred to as the individual mandate). The regs contain rules on, among other things, taxpayers' eligibility for the credit. The regs do not cover the treatment of "opt-out" payments for purposes of determining whether employer-sponsored coverage is affordable, a subject that was covered in the proposed version of the regs.   • Proposed regs would modify “net premiums written” for health insurance providers’ fee (12/9/2016) - IRS has issued proposed regs that would clarify and modify the current definition of "net premiums written" for purposes of the fee imposed by section 9010 of the Affordable Care Act (ACA), as amended.
  • Congress passes bill exempting small employer HRAs from ACA group plan rules (12/8/2016) - The Senate on December 7 passed, by a 94-5 vote, H.R. 34, the "21st Century Cures Act" (the Act) which was passed by the House of Representatives on November 30 by a 392-26 margin. The Act covers a wide-ranging group of nontax health subjects and also includes a provision exempting small employer health reimbursement arrangements (HRAs) from the Affordable Care Act (ACA)'s group plan rules. The Act is expected to be signed into law by President Obama.
