Consumer-Driven Health Care.

  • HSAs. We explain how the IRS changed the 2018 family contribution limit from $6,900 to $6,850 and then back to $6,900, as well as the relief offered for distributions based on the reduced limit. We also address IRS guidance clarifying that health plans covering male sterilization or male contraceptives on a no- or low-deductible basis are not HDHPs, along with the transition relief offered by the IRS.
  • HRAs. Our discussion of how Medicare Part D, the Medicare secondary payer requirements, and health care reform affect HRAs has been updated and streamlined for ease of use. In addition, we have updated the sample HRA plan document and its related Guide and SPD.

ERISA Compliance.

  • ERISA Preemption. We have revised the overview of federal preemption of state laws, and the summary of ERISA preemption, to more clearly describe the different types. Updates on preemption of specific state laws cover state mental health parity laws as applied to disability coverage, and slayer statutes.
  • Benefit Design Choices. Our coverage of key benefits design choices and legal constraints has been updated to flag new considerations for various types of welfare plans, including group health plans and severance benefits.
  • Case Law Developments. Case law updates include liability resulting from problems in the enrollment process, equitable remedies for fiduciary breaches, and the Sixth Circuit’s evolving jurisprudence on vesting of retiree medical benefits.
