Biden Administration Rule Would Revive Employer Pay Data Collection

The Equal Employment Opportunity Commission (EEOC) is proposing a rulemaking to amend regulations regarding the collection of pay data or related information for enforcing Title VII of the Civil Rights Act of 1964 and the Equal Pay Act of 1963. This proposal follows a previous pay data collection effort in 2017 and 2018 (known as EEO-1 Component 2 data), which was subsequently evaluated by the National Academies of Sciences, Engineering, and Medicine (see EEOC Announces Results of Analysis of EEO-1 Component 2 Pay Data Collection (08/02/2022)). Component 2 data includes employee counts, hours worked data, race and ethnicity by gender, job category and annual compensation ranges. The EEOC aims to use the findings from this evaluation to inform its approach to future data collections and will seek public comment on the new proposal. The EEOC anticipates that the proposed rule will be issued in January 2025.
